1. About You and Us
Who we are.
Hey there! We’re Maker Link SL, trading as Recast. Our registered address is Calle Virgen de Luján 39A, 2A, 41011 Sevilla, Spain (NIF: B16460180). When we say Recast, we, us, or our, we mean Maker Link SL.
What we do.
Recast is a peer-to-peer marketplace dedicated to secondhand fishing gear. Our platform (the "Site") enables users to:
List and sell fishing gear through a hosted marketplace (we are not party to any transactions);
Benefit from Buyer Protection, which helps ensure secure payments and allows refunds in case of lost, damaged, or significantly misrepresented items;
Access optional services, like promotional tools and verification features.
Who you are. You are a User of Recast if you:
Are at least 18 years old;
Have a registered account on the Site;
Use the Services for personal purposes, not professional (unless registered as a Pro Seller);
Are legally capable of entering transactions;
Accept these Terms and the Catalogue Rules.
Users can act as:
Sellers, who list fishing gear on the Catalogue;
Buyers, who purchase items from the Catalogue.
Pro Sellers are identified with a "Pro" tag. Additional terms apply and European consumer protection laws govern these transactions.
2. About These Terms
These Terms and Conditions ("Terms") are a legal agreement between you and Recast. They govern your use of the Site and our Services. You agree by registering an account or accepting updated Terms.
Defined words in bold have specific meanings. Catalogue Rules supplement these Terms. If there is a conflict, the Catalogue Rules take precedence.
We also link to other important documents including our Privacy Policy, Cookie Policy, and Help Centre.
3. Contacting Us
To report violations or illegal items: use our reporting tool or form for IP violations.
To raise a dispute: use our dispute form.
General queries: contact us at affiliates@recast.market.
4. Becoming a Recast User
Creating an Account. To use Recast, you’ll need to register an account with a valid email, username, and password. Please don’t use disposable or masked emails, as these may be blocked by our system.
Verifying your account. We may ask you at any time to verify your identity, contact details, or payment method. This helps us protect your account and prevent fraud. If you don’t cooperate or provide incorrect information, we may restrict or suspend your account.
Account limits. You’re allowed one personal account. If your account is compromised, we’ll help you recover or re-register. If you're a Pro Seller, you may also hold one additional Pro account, which must be tied to a separate email address and clearly distinguishable from your personal account.
Promotions and offers. Occasionally, we may run promotions, giveaways, or limited-time features for some or all users. During these times, the Site’s layout or functionality might temporarily change.
Third-party tools. Some Recast features use services provided by third-party platforms, such as payment processors or shipping partners. Their terms may apply separately.
Platform changes. To improve your browsing experience, we may reorganize how listings, featured items, or offers are presented. This won’t affect your listings or any rights under these Terms.
5. Using Your Information
Your personal data. We collect and process your personal data to provide our Services, comply with legal obligations, and protect our community. Please review our Privacy Policy for full details.
Using your content. By uploading content to the Site (like item photos, descriptions, and reviews), you grant Recast and its affiliates a non-exclusive, royalty-free, worldwide license to use, reproduce, adapt, and display your content for operational and promotional purposes. You can opt out of promotional use of your content anytime via your account settings.
Data responsibility. We take strong measures to protect your personal data. However, no system is 100% secure, so we encourage you to consider what information you share and understand that doing so is at your own risk.
6. What You Must and Must Not Do
You must:
To maintain a safe and respectful environment for all Recast users, you agree to:
Follow these Terms and applicable laws;
Provide accurate, up-to-date information and promptly update your Account details (e.g., shipping address);
Keep your login credentials secure and notify us immediately of any suspicious activity;
Share information from the Site only through permitted features such as the Share button;
Be responsible for the photos, descriptions, and any other content you upload (your "Content") and ensure you have the rights to share it.
You must not:
Use Recast to do anything illegal, unethical, or harmful to other users;
Upload content or communicate messages that are violent, hateful, discriminatory, or offensive;
Use bots, crawlers, or other software to scrape or manipulate the Site unless explicitly permitted by Recast;
Attempt to bypass our platform systems or misuse its functionalities (e.g., artificially promoting listings);
Delete and re-list the same item multiple times or mass-list items unfairly;
Harvest or misuse data from other users or the Site;
Promote outside websites, businesses, or marketplaces through your listings or messages on Recast.
We provide more guidance on acceptable behavior in our Community Standards.
7. Our Rights to Handle Concerns
Corrective actions.
If you violate these Terms or act in a way that undermines trust on the platform, we may take proportionate actions such as:
Sending a warning or reminder;
Removing or correcting your listings;
Hiding or removing your content;
Limiting features on your account (like messaging or listing visibility);
Temporarily or permanently suspending your account;
Notifying legal authorities if we believe there's a risk to public safety or a violation of law.
Blocking your account. We may block your account if:
You repeatedly violate these Terms despite warnings;
You provide false or misleading information or refuse to verify your account details;
You abuse platform features or engage in fraud or unsafe behavior.
Automated and legal enforcement.
We may use automated systems to detect rule-breaking or respond to legal notifications from authorities. If we take action, we’ll explain why and provide a way for you to appeal.
Urgent action without notice. We may block your account immediately and without prior notice if:
You’re involved in suspected fraud, scams, or other unlawful behavior;
There’s a credible threat to user safety, system security, or legal compliance;
We’re required to do so by law or legal request.
Appeals.
You can contest our actions by:
Submitting an appeal through your account notification;
Contacting our support team;
Using out-of-court dispute resolution channels;
Taking legal action in accordance with applicable law.
8. Recast Balance (Wallet) Setup and Use
What it is. Recast Balance is your in-app wallet. You can use it to:
Receive funds when you sell an item;
Purchase items on the platform;
Withdraw money to your personal bank account;
Pay for optional services on Recast.
Getting started. To activate your Recast Balance:
Visit your profile and follow the prompts under "Balance";
Complete identity verification as required (this may include providing your full name, address, and ID);
Agree to the terms of our payment services provider.
Who provides it.
Wallet and payment services are powered by Stripe.
Verification.
Our providers may conduct Know Your Customer (KYC) checks. If you fail or don’t complete the check, your wallet may be restricted.
Payouts.
You can transfer your funds to a linked bank account. Payout options and currencies depend on your location.
9. Payments
How to pay.
You can pay using:
Your Recast Balance (default, if funds are available);
Debit or credit card;
Other methods we may introduce.
Payment handling.
All payments are processed through trusted third-party providers. Funds are held securely in escrow until a transaction is completed.
Currency conversion.
If you purchase in a different currency, our providers may apply a small conversion fee (usually between 1.2% and 3%).
10. Messaging and Reviews
Private messages.
Use messaging only to discuss a listing or complete a transaction. Do not use it to send:
Spam or bulk messages;
Offensive, illegal, or inappropriate content;
External ads or promotions.
Leaving reviews.
You can review other users after transactions. Reviews must be fair and honest. Recast does not compensate for or pre-screen reviews.
11. Ending Your Relationship with Recast
Your choice.
You may delete your account at any time via your account settings or by contacting support.
Our choice.
We may terminate these Terms by giving you 30 days' notice.
After that. You’ll still need to complete any pending transactions or payouts. Once that’s done, your account will be closed.
12. Selling on Recast
What you can sell.
Only list items you own and have the right to sell. Items must:
• Relate directly to fishing (see Catalogue Rules);
• Be accurately described, including any defects;
• Include original photos (not stock images);
• Comply with applicable laws and our Prohibited Items list.
Listing an item.
Upload a photo, write a clear description, and set a fair price. Once listed, your item is visible to Buyers.
Counteroffers.
A Buyer may propose a lower price. Accepting a counteroffer does not obligate the Buyer until they complete the checkout.
Withdrawing a listing.
You may remove a listing at any time before a sale is completed.
13. Buying on Recast
How to buy.
To buy an item:
• Click the "Buy" button;
• Select a payment and shipping method;
• Confirm the purchase.
What you pay.
Buyers pay:
• The item price;
• Shipping fee;
• Buyer Protection fee (a small fixed fee + % of the item price);
• Any optional services selected (e.g. item verification).
Outside transactions. Purchases outside the Recast platform are not covered by Buyer Protection and are done at your own risk.
14. Buyer Protection
Purpose.
Buyer Protection ensures you’re eligible for a refund if:
• The item is lost in transit;
• The item is significantly not as described (SNAD);
• You receive a counterfeit (pending verification).
Filing a claim.
Report issues via the “I have an issue” button within 2 days of delivery.
Resolution.
You may need to return the item. If verified as SNAD or counterfeit, you’ll receive a full refund including shipping.
15. Optional Services
For Sellers.
You can purchase promotional tools like:
• Featured listings;
• Tacklebox boosts.
These are one-time purchases, non-transferable, and available in your Seller dashboard.
For Buyers.
Item Verification Services may be offered for select high-value items. You’ll see the fee and availability during checkout.
16. Shipping
Prepaid Shipping.
Recast partners with carriers to provide integrated shipping. Sellers must use the provided label.
Tracking and disputes.
Recast and our logistics partners track shipments. If something goes wrong, we rely on tracking data to help resolve disputes.
Lost or damaged items.
If eligible, Recast refunds the Buyer and may compensate the Seller if an item is lost or damaged in transit.
17. Site Content and Ownership
Recast owns all rights to the platform layout, features, trademarks, and original content. You may not copy, alter, or redistribute Site content without permission.
18. Availability and Maintenance
We aim for high uptime but may conduct routine maintenance or respond to force majeure events. We’ll notify users of planned downtime when possible.
19. Responsibility and Liability
You’re responsible for:
• Listings and content you post;
• Completing transactions you agree to;
• Following these Terms and community rules.
Recast’s liability. We are only liable for:
• Services we directly provide;
• Obligations under Buyer Protection;
• Damage caused by gross negligence or willful misconduct.
20. Dispute Resolution
Try our internal support first.
If we can’t resolve an issue, you can:
• Use EU Online Dispute Resolution;
• Contact your local consumer protection body;
• File a claim with your local court.
21. Final Terms
Changes to Terms.
We’ll notify you 30 days in advance of significant changes. If you disagree, you can close your account before changes take effect.
Assignment.
We may assign our rights and obligations under these Terms with 30 days' notice. You may not transfer your account.
No partnership.
These Terms do not establish any business partnership or joint venture.
Severability.
If one part of these Terms is deemed invalid, the rest remains enforceable.
